    Marketplace Guns Limited Company – Official Giveaway Terms & Conditions 

    1. Organizer

    This Giveaway (“Giveaway”) is organized by Marketplace Guns Limited Company (“the Company,” “we,” “us,” or “our”), a business operating in the State of Wyoming, United States of America.

    2. Eligibility

    • Open only to legal residents of the United States who are 21 years of age or older at the time of entry.
    • Entrants must be legally permitted to own or receive firearms and/or firearm-related merchandise under federal, state, and local law.
    • Entrants must not be prohibited persons under 18 U.S.C. § 922(g) (including, but not limited to, individuals convicted of a felony, subject to a restraining order, or adjudicated as mentally defective).
    • Employees, contractors, agents, and immediate family members of the Company or its affiliates are not eligible.
    • Void where prohibited or restricted by law.

    3. Entry

    • No purchase necessary to enter or win.
    • To enter, participants must submit a valid entry through complete the above form during the Giveaway Period.
    • Limit one (1) entry per person. Duplicate, automated, or fraudulent entries will be disqualified.
    • All entries must comply with applicable laws and platform policies.

    4. Giveaway Entry Period

    The Giveaway entry period ends on December 19, 2025 11:59 PM (“Giveaway Period”). Entries received after this period will not be accepted.

    5. Prize

    • The prize(s) will be clearly identified in the Giveaway announcement.
    • If the prize includes a firearm, it will be a new, legally transferable firearm as described.
    • If the prize includes firearm-related merchandise (e.g., optics, accessories, ammunition, gift cards), it will comply with all applicable shipping and ownership restrictions.
    • For prizes that do not require transfer through a Federal Firearms Licensee (FFL) (e.g., optics, holsters, clothing, magazines where legal, non-restricted accessories, and certain gift cards), see Section 7.2 below for transfer and shipping terms.
    • No cash alternative or substitution is permitted, except at the Company’s sole discretion.
    • The Company reserves the right to substitute a prize of equal or greater value if the stated prize is unavailable or unlawful to deliver in the winner’s jurisdiction.

    6. Winner Selection

    • The winner will be selected at random using an AI-assisted randomization system to ensure impartiality.
    • The AI system will not use any personal or demographic information in the selection process.
    • Winner notification: The winner will be notified by email on December 25, 2025.
    • Response requirement: The winner must respond and claim their prize within 14 business days of notification. Failure to respond will result in forfeiture and selection of an alternate winner.
    • The Company’s decision, including the AI-generated selection, is final and binding.

    7. Prize Transfer, Shipping & Compliance

    If the prize includes a firearm, the following apply:

    7.1 Firearm Transfer and Federal Compliance (Firearms & Items Requiring FFL)

    Transfer Through FFL:

    • The firearm will be shipped only to a Federal Firearms Licensee (FFL) chosen by the winner and approved by the Company.
    • The winner must complete all required ATF Form 4473 documentation and pass a federal NICS background check before taking possession of the firearm.

    Verification:

    • The winner must present valid government-issued photo identification that matches their entry information.
    • The FFL dealer will determine final eligibility according to federal and Wyoming state laws.

    Non-Transferability:

    • The firearm cannot be transferred, gifted, or sold by the Company to any third party on behalf of the winner.
    • If the winner cannot legally receive or own the firearm, the prize will be forfeited and no substitute firearm will be awarded (but see Section 7.3 for alternate prize policy).

    Shipping Restrictions:

    • Firearms cannot be shipped directly to the winner’s home. They will be shipped to the winner’s designated FFL.
    • The winner is responsible for any FFL transfer fees, background check fees, and local taxes.

    Alternate Prizes:

    • If a firearm prize is unlawful to transfer or receive in the winner’s jurisdiction, the Company may, at its discretion, provide an alternate prize of equal or lesser value (e.g., merchandise, store credit, or accessories).

    7.2 Items Not Requiring an FFL (Non-FFL Items)

    This subsection governs prizes that do not require transfer through a Federal Firearms Licensee (for example: optics, holsters, clothing, general accessories, certain gift cards, and other non-regulated items). All non-FFL items remain subject to applicable federal, state, and local law.

    Shipping & Delivery:

    • Non-FFL prizes may be shipped directly to the winner’s provided shipping address unless prohibited by law or the shipping carrier’s policies.
    • The Company will comply with any age-verification, shipping limitations, or carrier restrictions applicable to the prize. Where required by law or carrier policy, the winner may be required to provide proof of age or identity before shipment or delivery.

    Eligibility & Legal Restrictions:

    • The winner is responsible for ensuring that receipt, ownership, and use of the non-FFL prize are lawful in their jurisdiction. If local law prohibits receipt, the prize will be forfeited and the Company may, in its discretion, provide an alternate prize of equal or lesser value.
    • Certain items (e.g., ammunition, prohibited accessories, high-capacity magazines where banned) may still have legal restrictions; such items will not be awarded where prohibited and may be substituted.

    Fees, Taxes & Costs:

    • The winner is responsible for any applicable shipping costs, customs duties, import taxes, or other charges associated with delivery of non-FFL prizes unless the Giveaway announcement states otherwise.
    • Any applicable sales, use, or income taxes associated with the prize are the sole responsibility of the winner.

    Returns & Issues:

    • Non-FFL items are subject to the Company’s standard shipping, returns, and warranty policies. The Company will provide contact information for any issues or defects. The Company’s liability for defects in non-FFL items is limited to the remedies provided in the manufacturer’s warranty, if any, and applicable law.

    Verification:

    • The Company may require the winner to verify identity and/or eligibility (e.g., government ID, signed affidavit of eligibility) prior to shipping non-FFL prizes. A failure to timely provide requested verification may result in forfeiture.

    8. Publicity & Consent

    By entering, participants consent to the use of their name, likeness, image, voice, and city/state for promotional and marketing purposes by the Company in all media without additional compensation, unless prohibited by law.

    9. Limitation of Liability

    By participating, entrants agree that the Company, its affiliates, and agents are not liable for:

    • Lost, misdirected, or delayed entries;
    • Technical failures, errors, or interruptions;
    • Any injury, damage, or loss arising directly or indirectly from participation or prize use;
    • Any disqualification or forfeiture resulting from noncompliance with firearm laws or other applicable laws.

    Entrants release, indemnify, and hold harmless the Company, its affiliates, and employees from any and all claims arising from participation in the Giveaway or the acceptance, possession, or misuse of any prize.

    10. AI and Data Disclaimer

    • The AI-assisted selection system operates on random number generation algorithms designed to ensure fairness and transparency.
    • No personal data is used in the randomization process beyond entry verification.
    • Personal information will be handled according to the Company’s Privacy Policy and applicable federal and Wyoming data protection laws.

    11. Governing Law

    These Terms & Conditions are governed by and construed in accordance with the laws of the State of Wyoming and applicable federal law (including the Gun Control Act of 1968).
    Any dispute or claim shall be resolved exclusively in a state or federal court located in Wyoming.

    12. Modification or Termination

    The Company reserves the right to modify, suspend, or terminate the Giveaway at any time without prior notice, including if technical issues, fraud, or other factors impair its integrity or proper administration.

    13. Privacy

    All personal information collected during the Giveaway will be processed in accordance with Marketplace Guns Limited Company’s Privacy Policy and applicable federal and Wyoming privacy laws.
    Information may be shared with the FFL dealer for lawful verification and transfer purposes only, or with shipping carriers and vendors as necessary to deliver non-FFL prizes.

    14. Legal Disclaimer

    This Giveaway is not sponsored, endorsed, or administered by, and is not associated with, any third party or social media platform unless expressly stated.
    Participation constitutes full acceptance of these Terms & Conditions.

    All firearm prizes will be awarded in strict compliance with federal, state, and local firearm laws.
    The Company makes no representation or warranty that any prize can be legally owned or possessed in the winner’s jurisdiction.
    The winner is solely responsible for compliance with all applicable laws regarding ownership, possession, and use of the firearm or related merchandise.
